Point taken! Since part of the statement simply can not believed, i.e., that he was found hiding among the Confederate prisoners at Fort Delaware in January 1864, I am not as certain about the rest of the statement. The only credible scenario is that he was apprehended sometime after his desertion on 2/8 DEC 1863 from Camp Schenck near Baltimore and sent back to Fort Delaware instead of being returned to the Provost Marshal at Camp Schenck. So, the problem is to find that Fort Delaware record of transfer to Old Capitol Prison on 19 JAN 1864. It is still possible that the War Department clerk who penned the Memorandum got that part wrong as well.

I went through the Miscellaneous records posted at foonote.com and found CMSR cards documenting most of the information that you provided earlier. One additional record I found shows that Private Samuel F. MADDUX, Co. F, 42nd Virginia Infantry was forwarded from Harrisburg, PA to Philadelphia, PA on 9 JUL 1863. A significant number of Gettysburg captives arrived at Fort Delaware from Philadelphia having been first collected at Harrisburg. This dates his arrival at Fort Delaware following his initial capture between July 9th and July 12th, not July 6th as you had stated earlier.
