Hugh, as promised, here is the service record for Simeon F. Maddox, 3d Md. US. While it raises a number of questions, it has changed my mind to the extent that there was only one Samuel F. Maddox in the 42nd Va., who was also known as Simon and/or Simeon Maddox while a Union POW and serving in the 3d Md. As I indicated earlier, his Confederate service record (going to 1/1/63) is all from wartime company muster rolls at U.Va. Service after that is from Union POW records or his CSR in the 3d Md. To help identify the sources used in the entries below the service summary use this:

MADDOX, SAMUEL (SIMON, SIMEON) F.: Pvt., Co. I/42nd Va. Born Campbell County. Prewar farmer. Enl. 3/5/62, Lynchburg. Present in unit 4/30/62. Sent sick to Staunton hospital 5/6/62. Remained absent from unit through 1/1/63. During absence was furloughed, sick leave, by 6/30/62; was at home, sick, by 11/1/62 and AWOL from unit, at home, by 1/1/63. Captured, identified as a conscript, 42nd Va., during Gettysburg campaign at “Shade Gap,” 7/4/63. Union POW records also indicated he was captured at Gettysburg, Pa., 7/3/63 or “gave up at Chambersburg, Pa.,” on an unspecified date. Received at Fort Delaware, Del., 7/6/63. There on 8/30/63 was “desirous of entering the service of the U.S.” Joined G/3rd Md. Cav. U.S, Fort Delaware, 9/18/63, age 30, under name of Simeon F. Mattox, Pvt. Although his enlistment papers were lost, he was transferred to the 3rd Md. and sent from Fort Delaware 9/22/63. He was examined again for enlistment and was rejected by the surgeon; was re-examined and received, but was not mustered into the unit by 12/2 or 8/63 when he deserted at Camp Schenck, Baltimore, Md. Apprehended by 1/17/64 when he “was detected…as a Deserter from the U.S.A. as above name and organization [Samuel Merritt, 3rd Md. Cav] while a prisoner of war at Fort Delaware, Del., under name of Maddocks, 42Va…” Sent from Fort Delaware to Washington, D.C., on 1/19/64 for trial. Old Capitol Prison, Washington, D.C., to 5/3/64 when ordered to his regiment for trial as a deserter. Under name of Samuel F. Maddox, Pvt., I/42Va, at Old Capitol Prison, Washington, D.C., by 11/13/64 through 8/5/65. During this period, was hospitalized there, diarrhea,11/13 to 23/64 when released back to prison; hospitalized, intermittent fever, 12/10/64 to 8/5/65 when released; named 4/20/65 as Simeon F. Maddox, Pvt., 3rd Md. Cav. U.S., on a descriptive list of deserters “not taken up on Co. M[uster] R[oll] of Regt.”; and had his charge of desertion ordered removed 7/29/65. 6’ 1”, dark complexion, grey eyes, dark hair in 1863.

863/07/06 S.F. Maddox, Cpl., E/42Va, captured Gettysburg, Pa., 863/07/03, received Ft. Delaware 863/07/06. Subsequently joined 3d Md. US Cav [42Va: 340, 29474]

863/08/30 Samuel Maddox, Pvt., I/42Va, captured “Shade Gap,” 863/07/04 Born Va., a conscript, named 863/08/30 on a roll of POWs “desirous of entering the service of the U.S.” [42Va: 377, Samuel Maddox] [42Va: 377, Sam’l F. Maddox]

863/09/18 Simeon F. Maddox, Pvt., G/3Md Cav. US., enl. this day at Ft. Delaware, Del. However, his enlistment papers got lost. [42Va: 4g, Simeon F. Maddox]

863/09/22 Simon F. Maddox, F/42Va, born Va., captured Gettysburg, POW Ft. Delaware and transferred to 3d Md. Cav by this day when sent from Ft. Delaware. [42Va: 377, Simon F. Maddox]

863/12/02 Simeon F. Maddox, Pvt., G/3Md Cav. US., was examined again for enlistment and was rejected by the Surgeon; but was re-examined and received, but was not mustered in by this day when he deserted at Baltimore, Md. Alternate date of desertion from Camp Schenck [Baltimore] given as 863/12/08. [42Va: 4g, Simeon F. Maddox]

864/05/03 Samuel F. Maddox, Pvt., 3Md Cav. US, a deserter from his regt, ordered this day from Old Capitol Prison, Wash. DC, to his regt. for trial as a deserter. (Adj. Gen. Office SO 166/31) [42Va: 4g, Simeon F. Maddox]
