He was released from Camp Douglas on an exchange, therefore, Oath of Allegiance to the United States would not have occurred as he returned to service in
the Confederate States Army.

Following amputation of his right leg at the thigh, from wounds suffered at Chickamauga, he was retired for disability August 18, 1864.

At wars end, not being in the army of the Confederacy, he would most likely not have been subject to swearing to the Oath as a surrendered soldier.
